Terms of Service

Effective date: October 28, 2026

These Terms govern the use of Bússola, a recruiting and onboarding platform created by Tony Belleza, by the companies that subscribe to it and the people they authorize to use it.

1. Who we are and what these Terms cover

Bússola is a software service created and operated by Tony Belleza through Tony Belleza Consulting ("Bússola", "we", "us"). It is available at https://rh.tonybelleza.com.

These Terms of Service ("Terms") form a binding agreement between us and the company or organization that creates an account ("Customer", "you"). The person who accepts these Terms on behalf of a company confirms that they have authority to bind that company. If you do not agree, do not use the Service.

How we handle personal information is described in our Privacy Policy, which is part of these Terms.

2. Definitions

  • Service: the Bússola platform, including the jobs page, candidate area, manager dashboard, assessments, AI phone screening, interview scheduling, messaging and onboarding features, and related support.
  • Users: the managers, administrators and other people the Customer authorizes to access its account.
  • Candidates: people who apply to the Customer's jobs, and new hires who complete onboarding through the Service.
  • Customer Data: all information the Customer, its Users or its Candidates submit to the Service, or that the Service generates for the Customer, such as applications, resumes, test results, call recordings and transcripts, schedules and onboarding documents.
  • Francisca: the AI voice agent that places screening calls to Candidates on behalf of the Customer.

3. Accounts and users

  • You must provide accurate company and contact information and keep it up to date.
  • Each company has its own separate account. You are responsible for everything done under your account, for choosing who becomes a User, and for removing access when someone leaves.
  • Keep passwords confidential and tell us promptly at privacy@tonybelleza.com if you suspect unauthorized access.
  • The Service is intended for businesses. It is not offered to consumers for personal use, and Users must be at least 18 years old.

4. Free trial

New accounts may start with a free trial of 14 days. The trial includes the number of voice screening minutes shown at sign up, as configured by us at that time. During the trial, voice minutes cannot exceed the included amount.

We will remind you before the trial ends. If you do not choose a paid plan, access is paused at the end of the trial. Your data stays saved for 30 days so you can reactivate, after which it may be deleted or anonymized as described in the Privacy Policy. We may change or end trial offers at any time for new accounts.

5. Plans, voice minutes, overage and add-ons

  • Plans. Plans are priced mainly by the number of AI voice screening minutes included per month, together with other limits such as SMS messages, number of managers and whether a dedicated local phone number is included. Current plans and prices are shown on our pricing and sign up pages.
  • Billing cycle. Plans may be billed monthly or annually. Included minutes and messages apply to each monthly period and unused minutes and messages do not carry over to the next month.
  • Overage. When the included minutes are used up, calls pause until the next monthly period, unless you have turned on overage for your account. With overage turned on, extra minutes are billed at the add-on per minute rate shown on the pricing page. Overage is off unless you turn it on.
  • Add-ons. You may buy add-ons such as extra minutes, extra phone numbers or extra SMS messages at the prices shown when you buy them.
  • Usage records. Minutes are measured by our systems and our telephony and voice providers. Our usage records are used for billing, and you may ask us to review them if you think there is an error.

6. Billing and payment

  • Payments are processed by Stripe. Card and bank details are entered directly with Stripe and never touch or are stored on Bússola servers.
  • Subscriptions renew automatically at the end of each billing period until canceled. You authorize us, through Stripe, to charge the payment method on file for recurring fees, overage and add-ons.
  • Prices are in US dollars and do not include taxes, which you are responsible for unless we are required to collect them.
  • If a payment fails, we may suspend the Service after a short grace period of a few days and a notice to you.
  • We may change prices with at least 30 days notice. Changes apply from your next billing period.

7. Cancellation and refunds

You may cancel at any time. Cancellation takes effect at the end of the billing period already paid, and you keep access until then. Fees already paid are not refunded, including for partial months or unused minutes, except where a refund is required by law.

After cancellation, you may export your data during 30 days. We then delete or anonymize Customer Data within 60 days after the account is closed. Backup copies expire automatically within 14 days after that. Records we must keep by law (for example, billing records) are kept only as long as required.

8. Phone screening, calls and text messages

Francisca places outbound calls to Candidates who applied to the Customer's jobs, in English, Spanish or Portuguese. The Customer decides which roles use phone screening and configures its calling settings. Bússola places these calls only on the Customer's behalf and at its direction.

How calls work

  • At the start of the call, Francisca says it is an AI assistant (not a person), states that the call is recorded and asks for consent to continue.
  • Calls are recorded and transcribed, and the Service extracts facts and a screening summary from the conversation for the Customer.
  • If a Candidate asks not to be called, the Service marks the Candidate as "do not call" and stops further calls to that Candidate.
  • By default, calls are placed only Monday to Saturday, from 9:00 to 19:30, in the time zone set by the Customer, with a limited number of attempts. The Customer may narrow these settings and must do so where local law requires.

Customer responsibilities

  • The Customer is responsible for having a lawful basis and any consent required to call and text its applicants, including consent for calls that use an artificial or prerecorded voice, and for keeping proof of that consent.
  • The Customer must comply with the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule where applicable, state calling, recording and "mini TCPA" laws, call recording consent laws, carrier rules for business text messages (such as A2P 10DLC registration) and any similar laws in other countries.
  • The Customer must honor do not call requests, including requests received outside the Service, and must not use the Service for marketing or sales calls.

9. Hiring decisions, AI and employment law

  • The Customer is the employer. The Customer alone makes and is responsible for all hiring, rejection, compensation and employment decisions, and for its relationship with Candidates and employees.
  • AI is decision support. Call scores, tiers (for example STRONG or GOOD), summaries, DISC and B.A.S.E. results and resume analyses are tools to help people review applicants. They are not automated hiring decisions. A person at the Customer must review the information and make the decision. The Customer must not reject Candidates based solely on an automated output where the law requires human review, notice or an alternative process.
  • Non-discrimination. The Customer must comply with equal employment opportunity and anti-discrimination laws and with laws on the use of AI and automated tools in hiring that apply to it (for example, notice, bias audit or accommodation requirements). The Customer must offer reasonable accommodations to Candidates who cannot complete a phone screening or assessment.
  • Onboarding documents and tax forms. The Service provides templates and digital versions of forms such as offer letters, W-4, W-9, I-9 and CT-W4, and collects ID documents and payment details from new hires. The Customer is responsible for reviewing all templates and its configuration with its own legal and tax advisors, for completing employer sections (such as I-9 Section 2) correctly and on time, for classifying workers correctly, and for complying with employment, immigration, wage and tax laws. Bússola does not provide legal, tax or employment advice.

10. Acceptable use

The Customer and its Users must not:

  • call, text or email people who did not apply to the Customer's jobs, or upload purchased, scraped or third party contact lists;
  • use the Service for telemarketing, debt collection, political calls or any purpose other than recruiting and onboarding the Customer's own workforce;
  • discriminate unlawfully against Candidates or use the Service to ask unlawful interview questions;
  • violate employment, privacy, consumer protection, telecommunications or tax laws;
  • upload content that is unlawful, misleading or infringes the rights of others, or upload malware;
  • access another company's data, probe or attack the Service, bypass usage limits or security controls, or resell the Service without our written permission;
  • reverse engineer the Service or use it to build a competing product.

We may investigate suspected violations and suspend access when necessary to protect Candidates, other customers or the Service.

11. Customer Data and data ownership

  • The Customer owns its Customer Data and controls the personal information of its Candidates and employees. Bússola processes Customer Data only as a service provider (processor) on the Customer's behalf, to provide and support the Service and as described in the Privacy Policy.
  • The Customer is responsible for the accuracy and legality of Customer Data, for giving Candidates any notices required by law and for responding to their privacy requests, with our help where needed.
  • We do not sell Customer Data and do not use it to train general purpose AI models.
  • We may use aggregated or de-identified data that does not identify the Customer or any person to operate, secure and improve the Service.
  • Our Data Processing Addendum is part of these Terms and applies automatically whenever we process personal information on the Customer's behalf.

12. Third party services

The Service relies on third party providers, including Oracle Cloud Infrastructure (hosting in the United States), ElevenLabs (voice AI and call recordings), Twilio (telephony and SMS), Google Workspace (Gmail SMTP for transactional email), Stripe (payments, when enabled) and, only when the Customer enables it, Anthropic (resume analysis). The current list is in the Privacy Policy. These providers have their own terms, and we are not responsible for outages or changes caused by them, although we will work to limit their effect on you.

13. Confidentiality

Each party may receive non-public information from the other, such as Customer Data, pricing, product plans or security details. The receiving party will use that information only to perform under these Terms, protect it with reasonable care and not disclose it except to employees, contractors and providers who need it and are bound by similar duties, or when required by law (with notice where allowed). These duties do not apply to information that is public, already known, independently developed or lawfully received from someone else.

14. Intellectual property

Bússola, the Service, its software, design, content, the Francisca agent and the B.A.S.E. methodology are owned by Tony Belleza Consulting or its licensors. We grant the Customer a limited, non-exclusive, non-transferable right to use the Service during its subscription for its internal business. If you send us suggestions or feedback, we may use them without obligation to you.

15. Service availability and changes

  • We work to keep the Service available and secure, but we do not guarantee that it will be uninterrupted or error free. Maintenance, provider outages, carrier filtering and network problems can affect calls, messages and email delivery.
  • We may improve, change or remove features. If we remove a material feature you pay for, we will give reasonable notice. Features marked as new, beta or preview may change and are provided as is.
  • Support is provided by email at support@tonybelleza.com, Monday to Friday, 9 am to 5 pm US Eastern time, except US federal holidays. We aim to respond within 2 business days. No uptime commitment or service level agreement (SLA) applies unless agreed in writing.

16. Suspension and termination

We may suspend or terminate access if the Customer materially breaches these Terms and does not cure the breach within 10 days after notice, does not pay, or uses the Service in a way that creates legal risk or harm to Candidates, other customers or the Service. We may act immediately in serious cases, such as unlawful calling or a security threat. Sections that by their nature should survive termination (such as payment, confidentiality, liability and indemnity) survive.

17. Disclaimers

Except as expressly stated in these Terms, the Service is provided "as is" and "as available", and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, to the extent permitted by law. We do not warrant that AI outputs, transcripts, scores or extracted facts are complete or accurate, or that any Candidate is suitable for a job.

18. Limitation of liability

To the extent permitted by law, neither party will be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Each party's total liability arising out of or relating to these Terms will not exceed the fees the Customer paid to us under these Terms in the 12 months before the event giving rise to the claim. This cap does not limit the Customer's obligation to pay fees owed. These limits do not apply where the law does not allow them.

19. Indemnification

By the Customer. The Customer will defend and indemnify Bússola, Tony Belleza Consulting and their affiliates and providers against third party claims, fines and costs (including reasonable attorneys' fees) arising from: Customer Data; calls or messages made at the Customer's direction, including claims under the TCPA or similar laws; the Customer's hiring and employment decisions; or the Customer's breach of these Terms or of law.

By Bússola. We will defend and indemnify the Customer against third party claims that the Service, as provided by us and used in accordance with these Terms, infringes or misappropriates that third party's intellectual property rights, and will pay the resulting costs and damages finally awarded or agreed in settlement. If such a claim occurs or is likely, we may modify the Service, obtain a license or, if neither is reasonable, end the affected subscription and refund prepaid fees for the unused period. This obligation does not apply to claims caused by Customer Data, by combinations with items we did not provide or by use in breach of these Terms.

Process. The party seeking indemnity must notify the other party promptly, give it control of the defense and settlement (no settlement may impose an obligation on the indemnified party without its consent) and provide reasonable cooperation.

20. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to its conflict of law rules. Before filing a claim, each party agrees to try to resolve the dispute informally for 30 days after written notice to the other party (notices to us go to privacy@tonybelleza.com). If the dispute is not resolved, it will be decided exclusively by the state or federal courts located in Sacramento County, California, and both parties consent to their jurisdiction. There is no mandatory arbitration, and either party may bring an eligible claim in small claims court. Nothing in this section prevents either party from seeking urgent relief to protect its confidential information or intellectual property.

21. Changes to these Terms

We may update these Terms. For material changes, we will notify account administrators by email and in the app at least 30 days before they take effect. Continued use after the effective date means acceptance. If you do not agree, you may cancel before the change takes effect.

22. General

These Terms, the Privacy Policy and any order or plan selected in the Service are the entire agreement between the parties. If a provision is unenforceable, the rest remains in effect. Failure to enforce a provision is not a waiver. Neither party may assign these Terms without consent, except in a merger or sale of substantially all assets. Neither party is liable for delays caused by events beyond its reasonable control. Translations are provided for convenience; if there is a conflict, the English version prevails.
